The Committee on Legislative Support of Law Enforcement recommends that The Verkhovna Rada adopts the Bill on Amendments to the Law "On Prosecution" (re Procedure of Dismissal of Prosecutor General of Ukraine) as a basis and in its entirety.
The Bill (Reg. No.3113), coordinates the Law "On Prosecution" with the Constitution of Ukraine in the part of dismissal of the Prosecutor General of Ukraine. Thus, the Bill amends the Law " On Prosecution" and envisages that the Prosecutor General of Ukraine is appointed and dismissed by the President of Ukraine with the consent of The Verkhovna Rada of Ukraine.
The Committee members stated that The Verkhovna Rada adopted the Law "On Amendments to the Constitution of Ukraine" on 8 December 2004. It states that the Prosecutor General of Ukraine is appointed and dismissed by the President of Ukraine with the consent of The Verkhovna Rada of Ukraine.
However, the effective Law "On Prosecution" adopted before the Constitution of Ukraine was amended, envisages other procedure of dismissal of the Prosecutor General of Ukraine by the President of Ukraine alone. Therefore, it is necessary to introduce relevant amendments into the effective legislation.
